Ethics Discussion
For this assignment, you will discuss ethical issues related to digital forensics investigations.
Assessment
This activity supports the following course Student Learning Outcome:
- SLO 1. Explain legal and ethical issues related to the practice of digital forensics.
Requirements for this Discussion
- Review the posts that have been made in the forum so far, so that you can choose a different example or topic for your initial discussion post.
- Create a new topic in the forum for your initial discussion post. Choose one of the options below for your discussion topic. Prepare your initial discussion post according to the option requirements. This post must be in your own words and have good grammar and copy editing. You may NOT copy or substantially copy another person’s initial discussion post. If you want to make an initial post about the same topic as another person, you need to cite different sources and/or focus on another element of that topic.
- In your initial discussion post, cite sources as required by the option you select. You may cite Wikipedia articles directly. Provide enough information in your citation for someone else to locate the original source. Any citation style (APA, MLA, Turabian, IEEE, ACM, LNCS, or something you make up) is fine as long as the citations are complete and consistent.
- Your initial post must be at least 500 words in length for full credit.
- Participate in the forum by posting at least two (2) replies to other students’ posts. These replies must be at least 200 words in length for full credit and should cite sources as appropriate. You MAY post replies to discussions from options other than the one you picked for your initial discussion post.
Option 1: Book Discussion
For this option, you will make your initial post by presenting an example from James Duane’s book You Have the Right to Remain Innocent, which details some of the issues present in the United States criminal justice system.
Presentations by the Author
There are several videos and interviews that Prof. Duane has given over the years, which are available on YouTube:
- Don’t Talk to the Police - Edited version of Duane’s original viral presentation
- “You Have the Right to Remain Innocent” - Presentation at the Cato Institute
- You Have the Right to Remain Innocent with Professor James Duane - Interview of Prof. Duane
Please note that the above presentations should be used as a supplement to the book, not as a substitute! Duane revised some of his advice, especially what he gave in the original viral lecture, due to changes in case law.
Citations
For this option, cite page numbers in the book for your example. You may also cite any of the author’s presentations above, if they are relevant. You may also cite the original court cases, which might provide more detail that either supports or undermines Duane’s positions.
Option 2: Cell Phone Data Extraction
For this option, you will research and report on tools and techniques for extracting data from cell phones. In particular, focus on issues related to the ethics of breaking into someone’s phone to gather information for use in a court case.
Resources
Several vendors have created tools for extracting evidence from cell phones. Examples include, but are not limited to:
- Cellebrite UFED
- Grayshift GrayKey
- A somewhat dated but lengthier list can be found in NIST Special Publication 800-101 Rev. 1
You will need to find additional resources as part of your research. These links are simply starting points.
Citations
If you choose this option, cite at least 3 sources that you find as part of your research process.
