Assignment: Ethics in Digital Forensics

For this assignment, you will consider ethical issues related to digital forensics, including issues surrounding police interrogations and forced decryption of data.

Requirements

Prepare a video presentation that addresses the following:

  1. Explain how a person can be convicted of a crime based solely on their responses to police questioning, without the need for any other evidence. Give specific examples from the book and/or from Prof. Duane’s presentations, and cite the sources (including page numbers, if from the book).
  2. Describe the actions a person should take if an inspector general or other law enforcement agent wants to ask them a few questions.
  3. Discuss issues surrounding forced decryption of data.
  4. Consider this technical documentation: LVM on LUKS. Don’t worry if you don’t understand the documentation (unless you happen to be doing the project that requires this particular documentation in one of my other classes). Note how the system is configured with the encryption layer at the bottom, and the entire operating system is installed inside it. It isn’t possible to see or use any part of the operating system without first unlocking the system at boot time with GRUB. If the system is completely broken and doesn’t work, it would be necessary to enter a correct password to determine that fact. How might configuring a system like this make forced decryption more difficult under United States v. Hubbell?

If you elect to work with a partner, you should each present for approximately equal time.

Be sure to include the URLs to your portfolio (or both portfolios, if working with a partner) in the presentation.

Portfolio Items

Add the following components to your portfolio:

  1. A table summarizing the differences between the 5th Amendment and the 6th Amendment to the United States Constitution. At the bottom of the table, indicate which amendment to invoke if questioned by law enforcement.
  2. A brief summary of the main points of the Hubbell case.

Submission

Submit your presentation video to one of the weekly submission boxes for the course. If you’re working with a partner, only one person needs to submit the video.
