Last Will and Testament of Lewis King

Know all men by these presents that, I, Lewis King of the Borough of Etna, County of Allegheny and state of Pennsylvania, do make and publish this my last will and testament hereby revoking all former wills by me at any time heretofore made.

And as to my worldly Estate and all the property, real & personal, of which I shall die seized and possessed, I devise, bequeath and dispose thereof in the manner following, to-wit:

1st: My will is that all my just debts and funeral Expenses shall, by my Executor hereinafter named, be paid out of my Estate, as soon after my decease, as shall by him be found convenient.

2nd: It is my will and I do hereby give, devise, and bequeath unto my daughter Lilla M. Humphreys, with whom I am now and have been living, all my personal goods and chattels whatsoever, excepting therefrom my watch which I hereby give, devise and bequeath to my nephew Lewis King, son of Norman King, and I do hereby authorize and Empower my Executor hereinafter named, to deliver the said watch to my said nephew as soon after my decease as he may think proper.

Having already deeded to my said daughter Lilla M. Humphreys a lot on which there is erected a brick dwelling in the Borough of Etna aforesaid, it is my desire that she have no interest in the real Estate herein devised.

As to the real Estate, which I now own consisting of a lot with a frame house Erected thereon, in the Borough of Etna, aforesaid, I order and direct the said real Estate to be converted into money, as soon as the same can conveniently be done after my decease, and for that purpose, I do hereby authorize and Empower my said Executor hereinafter named to sell and dispose of said real Estate--the house and lot aforesaid--Either by public or private sale for the best price that can be gotten for the same, and by proper deed convey or assurance in the law, to be duly executed acknowledged and specified to grant, convey and assure the same to the purchaser or purchasers thereof in fee simple and clear of all encumbrances; the terms of the sale, as to time of payment of purchase money, shall be such as my executor, hereafter names, shall consider most advantageous.

And when said real Estate shall have been sold and converted into money as aforesaid, then I will and direct that the same shall be divided into two Equal parts or shares and disposed of by my executor hereinafter named, as follows to wit: - One full equal half part or share thereof after deducting one third part of cost of monument hereinafter mentioned, I give devise and bequeath to my daughter Mrs. Nancy Jane Bigham of Millvale Borough County and state aforesaid, to be paid to her by my executor, hereinafter named, as soon as collected from the sale of my real Estate aforesaid.

And the other Equal half part, or share thereof, after deducting one third part of cost of monument hereinafter mentioned, I give, devise and bequeath unto my said executor hereinafter named in trust for my five (5_ grandchildren Artlissa M. King, Lewis King, Margret King, Norman King and Ira King, the minor children of my son Norman King of Sharpsburg, county and state aforesaid, share and share alike, to be paid to them generally, with what interest may accrue thereon, as they shall generally arrive at the age of twenty one years.

And during the minority of my said grandchildren, on any of them, the said executor, hereinafter named, shall put and place the share or shares remaining unpaid of all on any of them and at interest on good security; so that each one shall receive; his or her one-fifth on arriving at the age of twenty one with interest on his or her share from the time of the investment by the said Executor hereinafter named and in case any of my said grandchildren shall die unmarried or shall die married but without issue, before arriving at the age of twenty one years, then his or her share go to the survivors or survivor Equally, share and share alike.

And it is my further desire and I hereby order and direct my executor hereinafter named to erect or cause to be erect, as soon after my decease as he may think proper a family monument on my burial plot in Greenwood Cemetery; said monument to have the names of all those buried in said plot inscribed thereon together with the date of birth and death of each; said monument not to exceed Five Hundred Dollars in cost and the said cost to e distributed as follows, to wit; One-third of said cost from my personal Estate, bequeathed to Lilla M. Humphreys as aforesaid, One-third of said cost from share bequeathed to Nancy Jane Bigham, as aforesaid. One-third of said cost from share bequeathed to my grandchild ___ as aforesaid.

And lastly, I do nominate and appoint my friend Rev. A. H. Calvert of Borough of Etna aforesaid executor of this my last will and testament.

In witness whereof, I the said Lewis King, have to this my last will and testament set my hand and seal, this 24th day of January A>D. 1887.
